Workout Samurai Terms of Service (including the End User License Agreement)

By downloading, installing, accessing, or using the App, by creating an account, or by clicking to accept these Terms, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you are using the App on behalf of another person or an organization, you represent that you are authorized to accept these Terms on their behalf.

These Terms include an embedded EULA that governs your license to use the App software, and they apply in addition to the terms of the app store through which you obtain the App (the Apple App Store or Google Play). If there is a conflict between these Terms and an applicable app store's rules concerning your license to use the App, the app store's minimum required terms will control to the extent required.

We have tried to write these Terms plainly. Where a word has a special meaning, we define it. Your continued use of the App after any update to these Terms constitutes acceptance of the updated Terms.

The App is intended for a general audience of teens and adults who train. It is not directed to, and is not intended for use by, children. You may use the App only if you can form a legally binding contract with us and are not barred from doing so under applicable law.

You must be at least 13 years of age to use the App. In regions where a higher minimum age applies to consent to the processing of personal data or to enter into online agreements (for example, 16 in certain parts of the European Economic Area and the United Kingdom), you must meet that higher age. If you are a minor in your jurisdiction but old enough to use the App, you may use it only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

We do not knowingly collect personal information from children under 13 (or the applicable higher age), consistent with the U.S. Children's Online Privacy Protection Act (COPPA) and comparable laws. If we learn that we have collected personal information from a child below the applicable age without proper consent, we will delete it. If you believe a child has provided us information, contact us at support@workoutsamurai.com.

Physical training carries inherent risk. By using the App, you represent that you are medically able to engage in push-up and calisthenics exercise, or that you have obtained clearance from a qualified healthcare provider. See the Health and Safety Disclaimer in these Terms.

Subject to your compliance with these Terms, the Operator grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and install one copy of the App on a mobile device that you own or control, and to use the App for your own personal, non-commercial training and entertainment. This is a license, not a sale; we and our licensors retain all right, title, and interest in and to the App.

This license is granted to you and, where the App is obtained through the Apple App Store, is subject to Apple's Licensed Application End User License Agreement, and this EULA is deemed to meet or exceed Apple's minimum terms. You acknowledge that this EULA is concluded between you and the Operator only, and not with Apple or Google, and that the Operator (not the app store) is solely responsible for the App and its content, maintenance, and support.

You further acknowledge, as required by Apple's terms, that: (a) Apple has no obligation to furnish any maintenance or support services for the App; (b) in the event the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any) for the App, and to the maximum extent permitted by law Apple has no other warranty obligation with respect to the App; (c) the Operator, not Apple or Google, is responsible for addressing any claims by you or a third party relating to the App or your use of it, including product liability, failure to conform to legal or regulatory requirements, and consumer protection claims; and (d) in the event of any third-party claim that the App or your possession and use of it infringes intellectual property rights, the Operator, not the app store, is solely responsible for the investigation, defense, settlement, and discharge of such claim to the extent required by these Terms.

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a 'terrorist supporting' country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You must comply with all applicable third-party terms of agreement (for example, your wireless data plan) when using the App.

You may not, and may not permit others to: copy, modify, or create derivative works of the App; reverse engineer, decompile, or disassemble the App except to the extent applicable law expressly permits; rent, lease, lend, sell, sublicense, or distribute the App; remove or alter any proprietary notices; or use the App in any manner that violates these Terms or applicable law. Apple and its subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance, will have the right to enforce it against you.

Your account begins as an anonymous, device-scoped account created automatically so you can start training immediately. You may optionally link your account to Apple, Google, or an email sign-in so that your progress survives reinstalls and can be recovered on a new device. Account authentication is provided through Firebase Authentication.

You are responsible for the activity that occurs under your account and for maintaining the confidentiality of any credentials used to access it. If your account remains anonymous and unlinked, your progress is tied to that device and may be permanently lost if the App is uninstalled, the device is reset, or the device is lost. We strongly encourage you to link your account to preserve your progress. We are not responsible for progress lost from an unlinked anonymous account.

You agree to provide accurate information where the App asks for it, to keep it reasonably current, and to notify us promptly at support@workoutsamurai.com if you believe your account has been accessed without authorization. You may maintain only one account for competitive purposes; operating multiple accounts to gain an unfair advantage on leaderboards or in clans is prohibited.

You may not buy, sell, rent, gift, trade, or otherwise transfer an account, or offer to do so. Accounts, progress, ranks, virtual items, and currencies are personal to you, have no ownership interest attached, and are non-transferable except as we may expressly permit.

Rank in Workout Samurai is earned on the floor. Our core promise is rank integrity: leaderboards, seasons, belts, and the dojo ladder reflect verified push-ups and honest effort. To protect that promise, you agree to the fair-play and community rules below. Violating them may result in flagged sessions, removal of ill-gotten progress, suspension, or termination.

Every ranked session requires an online, server-issued session; there is no offline ranked play. Our servers act as the authority: the client submits your intent and rep count, and our backend (Firebase Cloud Functions, protected by Firebase App Check) validates it. Sessions that reflect physically impossible input are rejected, and suspicious sessions may still count but are flagged for human review. We may adjust, withhold, or reverse results, ranks, and rewards that we reasonably determine were obtained in violation of these rules.

The on-device camera is used only to count your reps through computer-vision pose detection; the resulting rep count is what is submitted. You must not falsify, inject, replay, script, automate, or otherwise spoof rep counts or session data. This includes tampering with the App, emulating input, using bots or macros, exploiting bugs, or any similar means, all of which are strictly prohibited.

You are responsible for your conduct in shared spaces such as clans and leaderboards. Treat other athletes with respect. We may moderate, filter, and remove content and take action on accounts to keep the dojo honest and safe.

• Do not cheat, exploit bugs, or manipulate rep counts, session results, XP, coins, gems, ranks, or leaderboard standings.
• Do not use automation, bots, scripts, macros, modified clients, emulators, or GPS/sensor spoofing to generate or inflate reps or progress.
• Do not reverse engineer, tamper with, or circumvent server validation, App Check, anti-cheat systems, or in-app purchase flows.
• Do not buy, sell, trade, or transfer accounts, ranks, currencies, or virtual items, or advertise such transactions.
• Do not create multiple or shared accounts to gain competitive advantage, or coordinate to manipulate seasons or clan standings.
• Choose a display name and clan name that are lawful and respectful. Names are moderated and profanity-filtered; do not use names that are obscene, hateful, harassing, deceptive, impersonating, infringing, or that promote illegal activity.
• Do not harass, threaten, dox, or abuse other users; do not upload or transmit unlawful, infringing, or malicious content.
• Do not use the App for any commercial purpose, or to interfere with, overload, or attack our systems or the third-party services we rely on.

The App includes virtual currencies and items, including coins (earned by doing reps), gems (which may be purchased), and cosmetic assets such as armor, helmets, and weapons that surface as Strength or Defense flavor. Coins can be used to acquire cosmetic assets. These are all part of the game and are provided to enrich your experience.

Virtual currencies and items are licensed to you, not sold. You receive a limited, personal, non-transferable, revocable license to use them within the App. They have no monetary value, are not your property, do not constitute a balance in any real-world account, and cannot be redeemed for cash or any other item of monetary value from us or anyone else. We may regulate, limit, modify, remove, or discontinue virtual currencies and items at any time, and we do not owe you any refund or compensation for them except where required by law or the applicable app store's policy.

Money cannot buy rank. Gems, purchases, and subscriptions never buy, boost, or shortcut leaderboard rank, season standing, belt level, or dojo progression. Purchased gems buy cosmetics and do not confer competitive advantage. A coach cannot do your push-ups for you, and neither can your wallet. Every belt and every rung of the ladder is earned by doing verified reps.

Virtual currencies and items are non-transferable between users and between accounts. Unused virtual currencies and items may be forfeited if your account is terminated for a violation of these Terms, or if the App or a particular feature is discontinued, subject to any rights you have under applicable law.

The free game is fully playable forever: the rep counter, the dojo map and stage progression, coins and boss chests, solo and clan leaderboards, and clan creation and invites are free. "The Way" is our optional paid coaching program. It provides coaching only; it never provides a competitive advantage. The Way includes the three-track adaptive push-up program (First Form, goal 20; Second Form, goal 50; Master's Path, goal 100), the ACSM-style 2-for-2 progression rule, scheduled re-tests, coaching on form, tempo, and depth, Sensei insights, and earned completion titles. The Way builds and paces your plan; you still earn every rank by doing the reps. The App is supported in part by advertising, which is described in the Third-Party Services section below and in our Privacy Policy; we do not sell your personal data for money.

The Way is offered on the following plans, with prices shown in U.S. dollars (local pricing, taxes, and currency conversion may vary by region and are set through the app store): Annual at $39.99 per year, which includes a 7-day free trial and works out to about $3.33 per month; Monthly at $9.99 per month; and Lifetime at $89.99 as a one-time purchase with no free trial. Prices are subject to change. Any change will apply to future billing periods and will be disclosed to you as required.

Auto-renewing subscriptions (the Annual and Monthly plans) renew automatically. Payment is charged to your app store account at confirmation of purchase, and your subscription automatically renews at the then-current price for the same period unless you turn off auto-renewal at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period. The Lifetime plan is a one-time purchase that grants access to The Way and does not auto-renew.

If you start a free trial, any unused portion of the trial is forfeited when you purchase a subscription, where applicable. Unless you cancel at least 24 hours before the trial ends, the trial will automatically convert into a paid subscription at the price stated above, and your app store account will be charged. We may send an optional reminder before your trial ends, but it is your responsibility to cancel in time if you do not wish to be charged.

You manage and cancel your subscription through your app store account, not through us. On iOS, go to Settings, tap your name, then Subscriptions, and manage Workout Samurai. On Android, open the Google Play Store, tap your profile, then Payments & subscriptions, then Subscriptions, and manage Workout Samurai. Canceling stops future renewals; you generally retain access to The Way until the end of the current paid period. Subscriptions and purchases are managed on our side through RevenueCat, which sits on top of Apple App Store and Google Play billing.

Refunds are handled by the app store through which you purchased, according to that store's policies, not by us; we generally cannot issue refunds directly for app store transactions. Except where a refund is required by applicable law or granted under the applicable store's policy, all charges are non-refundable and there are no refunds or credits for partial periods, unused virtual items, or unused time. To request a refund, use Apple's or Google's refund process for your purchase. Certain jurisdictions grant statutory cancellation or withdrawal rights, which are not limited by this section.

The App lets you provide limited content, most notably a chosen display name, a clan name if you lead or create a clan, avatar and cosmetic selections, and similar profile elements (collectively, 'User Content'). You are solely responsible for your User Content and for ensuring you have the rights to use it and that it complies with these Terms and applicable law.

You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and use your User Content solely to operate, provide, secure, and improve the App, for example to show your display name on leaderboards and within your clan. This license ends when your User Content is deleted, except for reasonable backup copies and where retention is required by law or to enforce these Terms.

Display names and clan names are moderated and profanity-filtered. We may reject, change, or reset a name that we reasonably determine is offensive, infringing, impersonating, misleading, or otherwise in violation of these Terms, and we may remove User Content or restrict features to protect the community and the integrity of the game.

If you send us feedback, ideas, or suggestions, you grant us an unrestricted, perpetual, irrevocable, royalty-free right to use them for any purpose without obligation or compensation to you.

The App and all of its content and materials are owned by the Operator or its licensors and are protected by copyright, trademark, and other intellectual property laws. This includes the software; the on-device rep-counting technology and pose-detection implementation; the dojo, belt ladder, clan, season, and leaderboard systems; the Sensei coaching and program logic; text, graphics, the samurai mascot, the urushi black-lacquer visual design, and the gold-leaf, vermilion, and ember-orange styling; sounds, animations, and other design elements; and the 'Workout Samurai' and 'The Way' names and logos.

Except for the limited license expressly granted to you in these Terms, no right, title, or interest in or to the App is transferred to you, and all rights not expressly granted are reserved by the Operator and its licensors. You may not use our names, logos, or branding without our prior written permission.

We respect the intellectual property of others and expect you to do the same. If you believe content in the App infringes your rights, contact us at support@workoutsamurai.com with sufficient detail to identify the material and your claim, and we will respond as appropriate.

The App relies on third-party services to function. Your use of the App may be subject to those providers' own terms and privacy practices, and we are not responsible for third-party services except as required by law. Key providers include: Apple App Store and Google Play (distribution and payment processing); RevenueCat (management of subscriptions and purchases on top of app store billing); Firebase by Google, including Authentication, Firestore, Cloud Functions, and App Check (accounts, data storage, server-authoritative logic, and abuse protection); PostHog (product analytics); and third-party advertising partners and ad networks that serve, cap, and measure the ads shown in the App. Each provider's handling of your data is governed by its own terms and privacy policy.

Payments for subscriptions and in-app purchases are processed by Apple or Google, not by us. The App never receives your full card details. Billing, renewal, and refund mechanics are governed by the applicable app store as described in the subscriptions section above.

We use PostHog for product analytics, for example to understand the onboarding funnel and feature usage, so we can improve the App. Where required by law, you may limit or opt out of analytics; details and controls are described in our Privacy Policy. By default, analytics data is processed in U.S.-based cloud infrastructure.

The App displays advertising, including ads served through third-party advertising partners, ad networks, and mobile ad SDKs. To serve, cap, and measure these ads, advertising partners may collect and process device and usage identifiers, such as a mobile advertising identifier, IP address, and coarse device and usage signals, and they may show you personalized (interest-based) ads or non-personalized ads. Advertising partners handle this data under their own privacy policies, and we are not responsible for their practices except as required by law. You can limit personalized advertising through your device settings: on iOS, use App Tracking Transparency and the 'Limit Ad Tracking' or 'Allow Apps to Request to Track' controls; on Android, use your Google ads settings or reset your advertising identifier. You can also use any in-app advertising controls we provide. Where the law requires it, we ask for your consent before showing personalized advertising.

We do not sell your personal data for money. Because the App shows advertising, we may 'share' or make available limited identifiers (such as a mobile advertising identifier) to advertising partners for interest-based advertising, which certain laws, including the California Consumer Privacy Act as amended by the CPRA, may treat as a 'sale' or 'sharing' of personal information. You have the right to opt out of this sale or sharing. You can exercise it through the device and in-app advertising controls described above and through any 'Do Not Sell or Share My Personal Information' option we provide, and our Privacy Policy explains how to do this along with your other privacy rights.

The camera is used only for on-device push-up pose detection to count your reps. Camera frames are processed entirely on your device and are never transmitted, uploaded, or stored by us or any third party, including advertising partners; only the resulting rep count is submitted. Camera access requires your permission, and if you decline, the App still works using manual claim of reps. Optional local and push notifications may be used for training-day reminders and trial-end reminders, and you can control these in your device settings.

As between you and Apple, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as described in the EULA. Any inquiries or complaints relating to the App (including product and warranty claims) should be directed to the Operator at support@workoutsamurai.com, not to Apple or Google.

Workout Samurai provides general fitness and exercise information and coaching for entertainment and educational purposes. It is not medical advice, and it is not a substitute for the advice, diagnosis, or treatment of a qualified physician or healthcare provider. The Way is built on established strength methodology, including a 'hundred push-ups'-style progression and the ACSM 2-for-2 progression rule with deliberate recovery and periodic re-tests, but it is general programming and is not tailored to your specific medical condition.

Consult a physician or qualified healthcare provider before beginning any exercise program, and especially if you have or suspect a medical condition, are pregnant, are recovering from injury or surgery, take medication, or have any concern about your ability to exercise safely. Stop exercising immediately and seek medical attention if you experience pain, dizziness, shortness of breath, chest discomfort, faintness, or any other symptom of distress.

You are responsible for exercising within your own limits, using proper form, warming up, resting adequately, and ensuring your training environment is safe. Do not push beyond what is safe for you in pursuit of reps, ranks, streaks, or leaderboard position; rank is never worth injury.

We do not guarantee any particular fitness, health, performance, or results outcome; individual results depend on many factors outside our control. To the fullest extent permitted by law, you knowingly and voluntarily assume all risks associated with physical exercise and with your use of the App, and you agree that the Operator is not liable for any injury, harm, or loss arising from your training or your use of the App.

To the fullest extent permitted by applicable law, the App and all content and services are provided 'as is' and 'as available,' with all faults and without warranty of any kind. We disclaim all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, and non-infringement.

We do not warrant that the App will be uninterrupted, secure, error-free, or free of harmful components; that rep counting, pose detection, anti-cheat validation, or coaching will be accurate or complete in every case; that defects will be corrected; or that the App will meet your requirements or be compatible with your device or environment. Any material obtained through the App is used at your own discretion and risk.

Because the App depends on third-party services, connectivity, and your own device, we do not warrant the performance of those elements. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you, and you may have additional rights under applicable law.

To the fullest extent permitted by applicable law, in no event will the Operator or its owners, licensors, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, progress, virtual items or currencies, or other intangible losses, arising out of or relating to these Terms or your use of or inability to use the App, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to these Terms or the App will not exceed the greater of (a) the total amount you paid to us or through the applicable app store for the App in the twelve months immediately preceding the event giving rise to the claim, or (b) fifty U.S. dollars (US$50.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, such as liability for death or personal injury caused by negligence, for fraud, or for other liability that applicable law does not permit to be limited. These limitations reflect an allocation of risk and apply even if a limited remedy fails of its essential purpose.

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Operator and its owners, contractors, and service providers from and against any claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the App; (b) your User Content, including any display or clan name; (c) your violation of these Terms or applicable law; (d) your violation of the rights of any third party; or (e) your training activity and any injury or damage arising from it.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of that claim. You will not settle any claim that imposes any obligation or admission on us without our prior written consent.

You may stop using the App at any time and may request deletion of your account and associated data as described in our Privacy Policy and below. Uninstalling the App does not by itself cancel a subscription; you must cancel through your app store account. Account and data deletion is available on request via support@workoutsamurai.com and in-app.

We may suspend or terminate your access to the App or any feature, or remove content, at any time and without prior notice if we reasonably believe you have violated these Terms (including the fair-play rules), if required to protect the security or integrity of the Service or other users, or as otherwise permitted by law. Where feasible and appropriate, we will provide notice and, for less serious matters, an opportunity to cure.

Upon termination, your license to use the App ends, and you may lose access to your account, progress, ranks, virtual items, and currencies, which have no monetary value and are non-refundable except as required by law or the applicable app store's policy. Some sections of these Terms survive termination by their nature. These include intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

We may update these Terms from time to time, for example to reflect changes to the App, our services, or the law. When we make material changes, we will update the 'Last updated' date and provide reasonable notice through the App or by other appropriate means before the changes take effect. Your continued use of the App after the effective date constitutes acceptance of the updated Terms; if you do not agree, stop using the App and, if applicable, cancel your subscription.

These Terms are governed by and construed in accordance with the laws of [Governing law: to be specified], without regard to its conflict-of-laws rules, and any disputes will be subject to the courts or dispute-resolution mechanism of [Governing law and venue: to be specified], except where applicable mandatory consumer-protection law provides otherwise. [Note: the specific governing law, venue, and any arbitration or class-action provisions are to be finalized before launch.] Nothing in these Terms deprives you of the protection of mandatory provisions of the law of your country of residence.

If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and any app store terms, are the entire agreement between you and the Operator regarding the App.
